1. Agreement to Terms

By accessing or using ClaraHaus.ai ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you do not have permission to access the Service.

Age Requirement: You must be at least 18 years old (or 16 in Portugal and the EU with parental consent) to use this Service.

Legal Capacity: You represent that you have the legal capacity to enter into these Terms.

2. Description of Service

ClaraHaus.ai provides an AI-powered assistant service for condominium communities. The Service processes emails and documents forwarded by authorized users to provide intelligent answers about condominium policies, decisions, and history.

3. User Accounts

3.1 Registration

You must register for an account to use the Service. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate.

3.2 Account Security

You are responsible for safeguarding your account credentials and for any activities or actions under your account. You must notify us immediately of any unauthorized access to your account.

3.3 Account Types

  • Condominium Administrator: Can create condominium accounts, invite users, and manage settings
  • Authorized User: Can access condominium data and ask questions

4. Acceptable Use

4.1 Permitted Use

You may use the Service only for lawful purposes and in accordance with these Terms. You agree to use the Service only for:

  • Managing and accessing your condominium's communications and documents
  • Asking questions about your condominium's policies, decisions, and history
  • Other purposes expressly permitted by the Service

4.2 Prohibited Use

You agree NOT to:

  • Use the Service for any illegal or unauthorized purpose
  • Upload or transmit viruses or malicious code
  • Attempt to gain unauthorized access to any part of the Service
  • Interfere with or disrupt the Service or servers
  • Circumvent any security measures of the Service
  • Use the Service to process personal health information or other sensitive data not related to condominium management
  • Share access credentials with unauthorized parties
  • Use automated systems or software to extract data from the Service

5. Content and Data

5.1 Your Content

You retain all rights to the content you submit to the Service. By submitting content, you grant us a license to use, process, and store such content solely for the purpose of providing the Service.

5.2 Content Standards

You represent and warrant that:

  • You have the right to submit all content to the Service
  • Your content does not violate any third-party rights
  • Your content is accurate and not misleading
  • Your content complies with applicable laws and regulations

5.3 AI-Generated Responses

The Service uses artificial intelligence to generate responses. While we strive for accuracy, AI-generated content may contain errors or inaccuracies. You should verify important information independently.

6. Privacy and Data Protection

Your use of the Service is also governed by our Privacy Policy. By using the Service, you consent to the collection and use of information as described in the Privacy Policy.

7. Intellectual Property

7.1 Service Ownership

The Service, including its original content, features, and functionality, is owned by ClaraHaus.ai and is protected by international copyright, trademark, and other intellectual property laws.

7.2 Feedback

Any feedback, suggestions, or ideas you provide about the Service may be used by us without any obligation to compensate you.

8. Third-Party Services

The Service may contain links to or integrate with third-party services. We are not responsible for the content, privacy policies, or practices of any third-party services.

9. Disclaimers

9.1 Service Availability

The Service is provided "as is" and "as available" without any warranties of any kind. We do not guarantee that the Service will be uninterrupted, secure, or error-free.

9.2 AI Limitations

The AI-generated responses are based on the documents and data provided. We do not guarantee the accuracy, completeness, or reliability of AI-generated content.

9.3 No Legal Advice

The Service does not provide legal, financial, or professional advice. Always consult with appropriate professionals for such matters.

10. Limitation of Liability

10.1 General Limitations

To the maximum extent permitted by law, ClaraHaus.ai shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use or inability to use the Service.

10.2 Maximum Liability

Our total liability shall not exceed the amount paid by you to use the Service in the 12 months preceding the claim.

10.3 EU/Portuguese Users

For EU consumers, limitations of liability do not apply to damages caused by intent or gross negligence, or to statutory rights that cannot be limited or excluded under Portuguese consumer protection law (Lei de Defesa do Consumidor).

11. Indemnification

You agree to indemnify and hold harmless ClaraHaus.ai from any claims, losses, damages, liabilities, including legal fees, arising out of your use of the Service or violation of these Terms.

12. Termination

12.1 Termination by You

You may terminate your account at any time by contacting us at support@clarahaus.ai.

12.2 Termination by Us

We may terminate or suspend your account immediately, without prior notice, for:

  • Breach of these Terms
  • Conduct that we believe harms the Service or other users
  • Failure to pay applicable fees
  • Extended period of inactivity

12.3 Effect of Termination

Upon termination, your right to use the Service will cease immediately. We may delete your data in accordance with our data retention policies.

13. Modifications to Service and Terms

13.1 Service Changes

We reserve the right to modify or discontinue the Service at any time without notice.

13.2 Terms Changes

We may modify these Terms at any time. We will notify you of any material changes by posting the new Terms on this page.

14. Governing Law and Jurisdiction

14.1 For Users in the United States

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any legal action or proceeding shall be brought exclusively in the federal or state courts located in Delaware.

14.2 For Users in Portugal and the European Union

These Terms shall be governed by and construed in accordance with the laws of Portugal. Any legal action or proceeding shall be brought in the courts of Lisbon, Portugal. EU consumers may also bring proceedings in their country of residence.

14.3 International Users

For users outside the US and EU, these Terms shall be governed by the laws of the country in which the user resides, to the extent permitted by law.

15. Dispute Resolution

15.1 Informal Resolution

Before filing a claim, you agree to try to resolve the dispute informally by contacting us at legal@clarahaus.ai. We'll try to resolve the dispute informally by contacting you via email.

15.2 For US Users - Binding Arbitration

If we cannot resolve the dispute informally, any disputes arising from these Terms shall be resolved through binding arbitration in accordance with the American Arbitration Association rules. The arbitration shall take place in Delaware.

Class Action Waiver: You agree to bring claims against us only in your individual capacity and not as part of any class action.

15.3 For EU/Portuguese Users

EU consumers have the right to:

  • Bring proceedings in their country of residence
  • Use the EU Online Dispute Resolution platform at ec.europa.eu/consumers/odr
  • Seek resolution through Portuguese consumer protection agencies

Nothing in these Terms affects your statutory rights as a consumer.

16. General Provisions

16.1 Entire Agreement

These Terms constitute the entire agreement between you and ClaraHaus.ai regarding the use of the Service.

16.2 Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will continue in effect.

16.3 Waiver

No waiver of any term of these Terms shall be deemed a further or continuing waiver of such term or any other term.

16.4 Assignment

You may not assign or transfer these Terms or your rights under these Terms without our prior written consent.

17. Additional Provisions for Specific Jurisdictions

17.1 Portuguese Consumer Rights

Portuguese users have additional rights under:

  • Lei de Defesa do Consumidor (Consumer Protection Law)
  • Decreto-Lei n.º 24/2014 (Distance Contracts)
  • Right to withdraw from the contract within 14 days of signup
  • Access to CICAP (Centro de Informação de Consumo e Arbitragem do Porto) for dispute resolution

17.2 US State-Specific Rights

Certain US states provide additional consumer protections. These Terms are subject to applicable state laws including:

  • California: Additional rights under California Civil Code
  • New York: Protections under New York General Business Law
  • Illinois: Rights under the Illinois Consumer Fraud Act

18. Language

These Terms are written in English. If translated into other languages, the English version shall prevail in case of conflicts. Portuguese users may request a Portuguese translation by contacting us.
